Abstract

The main aim of the article is to identify the strengths, weaknesses, opportunities and threats of current IPR system in context to Indian regime and also to understand overall planning as well as important tactics and means to use IP legal protection system to fully safeguard one’s legitimate rights and interests, obtain and maintain competitive edges, restrain competitors and seek optimal economic performance by selection of appropriate IP strategies. This article also proposes ways to select IP strategy based on BCG matrix and product mix.

The history of Patent law in India starts from 1911 when the Indian Patents and Designs Act, 1911 was enacted. The present Patents Act, 1970 came into force in the year 1972, amending and consolidating the existing law relating to Patents in India. The Patents Act, 1970 was again amended by the Patents (Amendment) Act, 2005, wherein product patent was extended to all fields of technology including food, drugs, chemicals and micro organisms. After the amendment, the provisions relating to Exclusive Marketing Rights (EMRs) have been repealed, and a provision for enabling grant of compulsory license has been introduced.

I. INTRODUCTION

Information technology has heralded a new era of Communication System. It has revolutionized the whole commercial world. The mother earth looks like a global village where people sitting thousands of miles away can talk face to face, like people sitting across the table. Business men and consumers are using computer to create, transmit and store information in the electronic form. Traditional form of paper documents are being discarded for the reason that electronic method is Cheaper, easier to store, retrieve and communicate. Though these advantages are obvious but people were reluctant to transact business in electronic form due to lack of legal frame work, validating these transactions. All the paper transactions involved writing and signature to conclude them. These writings and signatures posed a great hurdle for electronic governance and electronic commerce for validating and enforcing them. The law of Evidence is based on paper made documents which should have been signature. Since electronic commerce eliminates the need for paper based transactions, hence to facilitate e-commerce the need for legal change has become an urgent necessity. International trade, though the medium of e-commerce, is growing by leaps and bounds for the past few years. Many countries have switched over from traditional paper based commerce to e-commerce. The instantaneous means of communications through internet have been a great menace to copy right in different areas David Teather from London has reported that the International Federation of the Phonographic Industry say that the market in year 2000 was worth $36.9 billion, a fall of 1.3 per cent on the previous year. The biggest decline in the sale of C.D. singles was 39% and globally it fell by 14%. The growth in popularity of Napster and to contain the damage. Napster is in the process of removing copyrighted material from its site.¹ But the powers of the computer are so great that the law enforcement agencies are facing a real challenge to contain its onslaught. Internet telephony is a common sight at cyber cafe, despite the fact that it is illegal.2 B.B. Nanda and R.K.Tewari observe that “ internet paedophilia, computer network break-ins, industrial espionage, Child pornography password sniffling, spoofling, telecommunications fraud, software piracy, e- mail bombing and spamming, and the availability of illicit or unlicensed products and services are offences already making themselves felt. Emerging problems include credit card fraud, cyber terrorism, cyber laundering and criminal use of secure internet communications. The huge growth of internet will breed cyber fraud with great ease especially in the area of share-holdings of companies.3 The present weak electronic system of payment without adequate safeguard is posing a serious risk for unauthorised withdrawals from banks and counter money laundering operations. Software piracy is a boom business and video and phonographic industries are sinking day by day globally.4 The UNCITRAL Model law provides for equal legal treatment of users of electronic communication and paper based communication. In pursuance of a declaration made ‘by Member Countries, the World Trade Organisation (WTO) is about to form a work programme to handle its work in this area including the formation of multilateral trade deals through the medium of electronic commerce. The paper discusses, briefly, the meaning of cyber space the origin and development of intemet and e commerce its uses and abuses. Certain provisions relating to Information Technology Act, 2000 have been briefly discussed to apprise oneself about its effectiveness in meeting the challenges posed by e commerce in different areas.

Infrared spectroscopy (IRspectroscopy) is the spectros copy that deals with the infrared region of the electromagnetic spectrum, that is light with a longer wavelength and lower frequency than visible light. It covers a range of techniques, mostly based on absorption spectroscopy. As with all spectroscopic techniques, it can be used to identifyand study chemicals. A common laboratory instrument that uses this technique is a Fourier transform infrared (FTIR) spectrometer.

The infrared portion of the electromagnetic spectrum is usually divided into three regions; the near-, mid- and far- infrared, named for their relation to the visible spectrum. The higher energy near-IR, approximately 14000–4000 cm^–1 (0.8–2.5 μm wavelength) can excite overtone orharmonic vibrations. Themid-infrared, approximately 4000– 400 cm^–1 (2.5–25 μm) may be used to study the fundamental vibrations and associated rotational-vibrational structure. The far-infrared, approximately 400–10 cm^–1 (25–1000 μm), lying adjacent to the microwave region, has low energy and may be used for rotational spectroscopy. The names and classifications of these sub regions are conventions, and are only loosely based on the relative molecular or electromagnetic properties.

Infrared spectroscopy exploits the fact that molecules absorb specific frequencies that are characteristic of their structure. These absorptions are resonant frequencies, i.e. the frequency of the absorbed radiation matches the frequency of the bond or group that vibrates. The energies are determined by the shape of the molecular potential energy surfaces, the masses of the atoms, and the associated vibronic coupling.

I. PUBLIC POLICY CONCERNS

The working of the Trade Related Aspects of Intellectual Property Rights Agreement (TRIPS) Agreement, 1995 along with World Intellectual Property Organization (WIPO) and the jurisprudence developed for the last twenty years is a testimony to the fact that although TRIPS is geared to promote the protection of intellectual property rights internationally, yet some controversial public policy issues need to be addressed and solutions devised for addressing these public policy issues otherwise there is a possibility of seeing the demise of TRIPS Agreement or sidetracking it by some other methods which may not be conducive for maximizing the welfare of the international trading community. As all of us know that intellectual property and international trade are mutually inclusive and the minimum standards set forth in the TRIPS Agreement are economically value oriented. The trade offs among and between the members of the WTO need to be balanced on an even keel, otherwise the possibility of camaflouging the TRIPS Agreement and the attendant jurisprudence becomes real. The TRIPS Agreement addresses seven categories of IP rights such as; Copyright and related rights; Patents; Trademarks and Service marks; Geographical Indications; Undisclosed Information or Trade Secrets; Industrial Designs ; and Layout Designs of Integrated Circuits and read with other WIPO Treaties obligates the members of the World Trade Organization (WTO) to reduce distortions and impediments to international trade by taking into account the effective and adequate protection of intellectual property rights as well as the procedures for the enforcement should not become barriers to international trade. The TRIPS Agreement also recognizes the need to cater to the special needs of the developing and least developed countries.

Early and accurate crop-disease diagnosis is essential for preventing production losses and reducing unnecessary pesticide use. Manual diagnosis can be slow, subjective and difficult to apply across large agricultural areas. This chapter introduces computational approaches using artificial neural networks, fuzzy logic, support vector machines, deep learning and hybrid optimization models. It discusses image acquisition, preprocessing, feature extraction, pattern recognition and classification of disease symptoms from leaves, crop canopies and sensor data. Integration with precision-agriculture systems, mobile advisory applications and real-time monitoring enables timely intervention. Challenges involving data quality, field variability, model interpretation and large-scale deployment are examined through practical examples and case studies.

5.1 Introduction

The application of chemical pesticides is crucial in horticultural production, but it is also one of the most hazardous agricultural operations. Overapplication can lead to significant environmental concerns. Spraying is vital for reducing harvest losses and improving productivity. According to Cho et al.,(2012), 30-35% of production damages can be prevented by reducing harmful insects and diseases through spraying. Plant protection is essential for ensuring yield quantity and quality. Effective pesticide use is crucial, as excessive application can lead to pests developing immunity, destruction of beneficial insects and natural pest enemies, and increased harmful insect populations. Excessive pesticide use also disrupts pollination, preventing fruit formation. The method of pesticide application is key to targeting the correct quantity and quality, reducing environmental contamination, and increasing sustainability (Abbas et al., 2020). Site-specific application rates in precision horticulture can decrease pesticide use. Only 30-40% of pesticides typically reach their targets, with most lost to the environment, contaminating workers and causing pollution. Protecting plants with chemicals aims to prevent infections and ensure healthy growth.

Spray drift can harm non-target plants and contaminate watercourses, posing a severe and costly problem for horticultural farmers using air-assisted variable sprayers (Seol et al., 2022). Spray drift refers to airborne spray droplets moving beyond the intended application area from aerial or ground-based methods. Studies have found that a significant portion of pesticides is lost to the air and ground, with up to 30-50% of the applied pesticides being lost through various means (Abbas et al., 2020). Modern trends emphasize the importance of sensors and precision agriculture for effective pesticide use. Understanding tree canopy physical features is crucial for effective spray application. This study focuses on recognizing and geometrically classifying canopies for adequate pesticide protection. Variable rate spraying targets only the canopy, enhancing pesticide application efficiency (Rathnayake et al., 2022). Electronic methods and innovative equipment reduce operational and environmental costs. Sensors tracking canopy characteristics and spacing ensure optimal use of inputs, promoting sustainability.

Computational crop-disease detection uses machine learning, neural networks and image-processing techniques to provide timely and accurate diagnoses. This chapter presents a complete framework covering agricultural intelligence, disease categories, image acquisition, preprocessing, model training and classification. It examines datasets collected in fields or through drones and considers deployment through mobile devices, cloud platforms and other digital systems. Evaluation measures are introduced for assessing model accuracy and reliability. The chapter also considers limitations caused by insufficient or poor-quality data and variation in field conditions. Future directions include multimodal data integration and explainable models that provide transparent recommendations for sustainable crop protection and improved food security.

A pear shaped volume (interaction volume) is formed as shown in Fig. 1 and this volume of excitation increases with increase in the beam voltage (electron energy) and decreases with the increasing specimen density (ion atomic number).

8.1 Introduction

Interferometric or phase modulated sensors have received special attention because these are much more sensitive than intensity modulated sensors and can be used over a much larger dynamic range. The sensors rely on the interferometric technique. Generally, the sensor employs a coherent light source such as a laser and two single mode optical fibers. Light is split and coupled into both the fibers. If the measurand perturbs the optical properties of one of the fibers relative to the other, a phase shift occurs. The change in phase can be measured very precisely. For the measurement a sophisticated electronic processing equipment is needed. Thus the interferometric sensors are expensive compare to intensity modulated sensors. There are four kinds of interferometer configurations: Mach-Zehnder, Michelson, Fabry-Perot and Sagnac interferometers. The Mach-Zehnder, Michelson and Sagnac interferometers are the two beam interferometers while in the case of Fabry-Perot interferometer multiple beam interference occurs. In this chapter we shall first describe interference phenomenon and then different kinds of fiber optic interferometers. In the end we shall describe a number of sensors based on interference phenomenon or phase modulation.

Introduction

The International Patent Classification, commonly known as the IPC, is based on an international multi-lateral treaty administered by World Intellectual Property Organization (WIPO). This treaty is called the Strasbourg Agreement concerning the IPC, which was concluded in 1971 and came into force on October 7, 1975. The Agreement aimed to overcome the difficulties caused by using diverse national patent classification system. The common classification system defined by the Agreement is applied to patent and utility model documents. The Agreement is open to States party to the Paris Convention for the Protection of Industrial Property.

The Internet of Things supports continuous monitoring of soil, crops, weather and other field conditions through distributed sensors and connected devices. This chapter proposes an edge-cloud architecture designed to address scalability, heterogeneous data, communication latency and energy requirements. Edge nodes conduct local processing and anomaly detection, while cloud platforms provide storage and run advanced machine-learning models. Applications include crop-status evaluation, irrigation scheduling, pest and disease detection and yield forecasting. Explainable artificial intelligence improves transparency by helping users understand model recommendations. The integrated architecture can reduce response time compared with conventional centralized systems and provides a foundation for scalable, efficient and responsive next-generation smart-farming operations.

Computational intelligence is enabling agriculture to evolve into a data-driven, adaptive and increasingly autonomous system. This chapter introduces its concepts, scope and role in smart agriculture by presenting farms as interconnected cyber-physical-biological environments. It discusses artificial intelligence, data analytics and decision-support systems and explains the progression from traditional farming to precision and smart agriculture. IoT, remote sensing, cloud platforms and digital agricultural ecosystems are examined as enabling technologies. The chapter also considers socioeconomic, environmental and scalability challenges. It establishes the conceptual and architectural foundation required to understand how computational intelligence can improve productivity, sustainability, resilience and decision-making in next-generation agricultural systems.

2. Data Integrity Assurance: The primary objective is to guarantee the dependability of data generated, thereby fostering confidence in safety assessments.
3. Regulatory Compliance Support: GLP facilitates adherence to regulatory standards, enabling the acceptance of study findings by authorities worldwide.
4. Non-Clinical Safety Focus: It specifically applies to studies that precede human clinical trials, particularly those evaluating the potential hazards of chemical substances (OECD, 1998).

The IoT is a system with interrelated computing devices, digital and mechanical machines, objects, animals or people each with an unique identifiers (UIDs ). Internet of Things can be used to design products for businesses. The added value to the businesses over IoT is created by the information which is collected by connected devices. The process has five phases of lifecycle, first phase is ‘create phase’, where sensors collects the data from environment. This data can generate the information. Second is ‘communicate phase’ where data generated in first phase is communicated to the required destination. Third is ‘aggregate phase’ where collected data over network is aggregated by device itself. Fourth is ‘analyse phase’ where aggregated data is used to generate patterns and use it to control and optimize the process. Fifth is ‘act phase’ where actions are taken on the basis of information extracted from the aggregated data.

Abstract

An intellectual property infringement is the violation of an intellectual property right of the owner. Infringement is established based on the law governing appropriate IPR in the concerned country. Both civil and criminal remedies are available under the concerned law. The present paper introduces the patent infringement as per Indian Patent Act, 1970. It discusses various modes and types of infringements which can take place. It further discusses a procedure to formulate opinion about product infringing a granted patent. In the end some usual defenses against patent infringements have been discussed. Some case studies have also been presented along with the damages awarded for the patent infringement.

Introduction

‘IP’ refers to unique, value-adding creations of the human intellect that results from human ingenuity, creativity and inventiveness. An IP right is thus a legal right, which is based on the relevant national law encompassing that particular type of intellectual property right. Such a legal right comes into existence only when the requirements of the relevant IP law are met and, if required; it is granted or registered after following the prescribed procedure under that law. All countries around the world have a national legal system of intellectual property rights which has developed over varying periods of time during the last 150 years or so. It has enabled the grant of property-like rights over such new knowledge and creative expression of mankind, which has made it possible to harness the commercial value of the outputs of human inventiveness and creativity. This is usually done by its orderly use, exchange or sharing it amongst various types of business partners in a complex network of strategic relationships that generally work harmoniously during the new product development process for creating and marketing new and improved goods and services in domestic and export markets.

IPR is a tool for Innovation and reward for it. Innovations are concerned with the commercialization of new ideas; in contrast, an ‘invention’ may not be directly associated with commercialization. As such, innovation may be seen as a process of interaction and feedback during the various stages of the new product development process. An invention is considered as the generation of a new idea or knowledge, which aims to solve a specific technical problem. Inventions could relate to products or processes and are characteristically protected by trade secrets, utility models/petty patents or patents. Utility models/petty patents or patents are granted/registered under the relevant national/regional law by the relevant national or regional patent office. As not all inventions are commercialized, so it is clear that not all inventions result in innovations.

Keeping in view the importance of intellectual property rights and their protection, Journal of Intellectual Property Rights (JIPR) was started in 1996. The objective of the journal is enhancing communication between policy makers, organizational agents, academics, and managers on the critical understanding and research on intellectual property; and to promote the development of the newly cultivated research field. The journal publishes contributed/invited articles, case studies and patent reviews; technical notes on current IPR issues; literature review; world literature on IPR; national and international IPR news, book reviews, and conference reports.

ABSTRACT

This paper attempts to portray prevailing scenario of IPR in the light of globalization with special emphasis on harmonization of IPR systems and laws of different countries. 

INTRODUCTION

The globalization of information, facilitated by the Internet, has significant implications for intellectual property regimes of national and international levels. Assessment of these implications and their probable outcomes is unavoidably value-driven. Globalization represents ever-increasing influence of developed nations and transnational entities over developing and less developed nations. The process has also brought in significant changes in understandings of sovergenity. An analysis of the implications of globalization of information on international and domestic intellectual property rights and legal regimes is a complex endeavor.

ABSTRACT

This paper discusses IPR concepts in the light of Indian culture and issues emanating from enforcement of those concepts in developing countries such as India.

INTRODUCTION

The adage “Knowledge is wealth” suits the present era well than any other period. India is known for its innovative thoughts since ages. However, it never monopolized the knowledge it possessed. In India, the knowledge of a person is thought to be utilized for the benefit of the society as an obligation of the knowledge holder. Does this mindset of Universal humanity (Vasudevo Kudumbagam) and common good (Sarva Sugino Bavandu) would benefit us in the materialistic society? This paper is an attempt to answer this query.

I. INTRODUCTION & OVERVIEW

Intellectual property rights may be defined as the legal relationships that arise out of an individual’s creative gifts and the communication to society of his or her intellectual creations. Intellectual property is challenging as well as rapidly widening horizon of law. The purpose of law is to encourage and reward creativity and intellectual effort. The prominence of this branch of law in India is partly due to India’s economic structure and its geographical position in the world. Many international companies operate in India either directly or through licensees or agents. Numerous goods, services, and technological developments have overseas origins. Foreign companies often control their interests through contract but they invariably do so by means of copyright law, obtaining of patents or by registration of trade-marks and designs. It follows that in particular circumstances intellectual property remedies are most convenient method of maintaining control, or at least a useful adjunct to other remedies based on contract. Another important factor is the upsurge in “piracy” that is occurring not only in India but also in almost every other part of the world. Piracy may originate outside India, or, it may also originate in lndia. While devising legal apparatus for the welfare and protection of creative people, we must not lose sight of the public interest in the greatest measure of access to information and culture. Intellectual property rights are significant wealth- creating assets and their protection and commercialization are of increasing economic significance. In past the value of such rights was often overlooked and it is only in recent years that the economic potential of intellectual property has started receiving greater recognition. The dawn of the third millennium which has led to the emergence of knowledge capitalism with emphasis on intangible assets such as knowledge, competencies and intellectual property is a defining movement in the history of mankind. It is a defining moment in the history of mankind because the historical forces set in motion by the digital revolution has spawned a new civilization characterized by path breaking inventions and technological innovations and the opening up of the electronic frontier. It is an age of digital renaissance which combines the marvels of the Age of Discovery and the excellence of medieval Renaissance rolled into one. As a result of the information technology revolution there is a transition from industrial society to information society. Convergence of computer networks and communication technologies facilitated by the digital revolution has given birth to Cyberspace which in turn has ushered in knowledge economy. Hence, the intellectual property law faces challenges. In this background the concept, nature and development of intellectual property rights are proposed to be examined. The paper will be divided into V more parts. Part II of the paper will outline the meaning concept of intellectual property and range of subject matter protected by law, part III will examine the jurisprudential justifications of intellectual property protection, part-IV will explore the evolution and development of intellectual property rights under international law, part-V will demonstrate the evolution and development of intellectual property rights under Indian law. And part-VI will conclude the subject.

Introduction
According to the U.S. Food and Drug Administration (FDA), Good Laboratory Practices (GLP) is a quality system that ensures the nonclinical safety studies are appropriately designed, conducted, and documented to generate reliable data. The laboratory techniques are defined as the processes and practices that are recommended for equipment use in the laboratory, while laboratory methods are based on established scientific principles involving biology, chemistry, and physics, and encompass all aspects of the clinical laboratory from testing the amount of cholesterol in blood to analysing DNA to growing microscopic organisms that may be causing an infection. One of the most significant parts of laboratory techniques and laboratory methods is the proper validation of the equipments (old or new equipments) as well as all the testing procedures/ methods (established or newly developed methods). Analytical method validation is a critical process to ensure the quality and safety of products. The objective of the validation of an analytical method is to demonstrate that it is suitable for its intended purpose; the results are authentic and universally acceptable. An analytical method is suitably well considered when the results generated through different method are consistent, reproducible, and thus, reliable.

• Revision of established method
• Use of established methods in different laboratories and different analysts, etc.
• Comparison of methods required
• When quality control indicates method changes

6.1 Introduction

This chapter describes the development of data logger of agricultural field parameter monitoring system with LabVIEW. The system comprises of two sections- Fields device and data logger. Field device comprises of Arduino, smoke detector (for sensing hazardous gases), soil moisture sensor, temperature sensor, humidity sensor, water level sensor, battery, display unit, 2.4 GHz RF modem. Data logger comprises of Arduino, display unit, 2.4 GHz RF modem, power supply, PC with LabVIEW. The system is designed to monitor the environment and agriculture field parameters. The field device is designed to collect all physical parameters and communicate it to the receiver end with LabVIEW. For establishing communication between two sections 2.4GHz RF modem is used, which can be replaced with any other modem also.Fig.6.1 shows block diagram of field device and Fig.6.2shows block diagram of data logger.Table.6.1 & Table.6.2 shows the component list required to develop the field device and data logger.

I. MANDATE OF COPYRIGHT LAW

The importance of intellectual property rights has arisen in recent years to a great extent. The law of copyrights protects original forms of expression i.e. Novels, Movies, Musical compositions and computer software etc. Earlier it was mainly confined to the -published Work and owner of it could prevent others from getting it published in the form of books or articles in order to get benefit in terms of money or goodwill or reputation. In case of such undue enrichment, the owner had a valid cause of action. The owner of the copyright has a valid cause of action against the violator. At present even in case of its adoption and translation or abridgement, it is obligatory to have consent of author. The main purpose and object of copyright law is to protect the expression in any other form from unauthorized use. Since 1847, the copyrights law is in developing stage so, many legislations has been enacted.1 With the changing of times, the meaning of expression also changes and the style of exhibit the things also changed. The right of author who gives expression in any form is protected from unauthorized use.

Introduction 
The transformation of governance through digital means represents one of the most consequential shifts in contemporary public administration. Digital governance or e-governance entails strategically applying information and communication technologies (ICTs) to enhance the accessibility, efficiency, transparency, and responsiveness of government functions and public service delivery. In India, this digital shift has accelerated over the past two decades, driven by imperatives to modernise the state apparatus, promote inclusive development, and meet the rising expectations of a digitally literate citizenry. A complex interplay of demographic diversity, federal administrative structures, and asymmetries in socio-economic development shapes India’s trajectory toward digital governance. The proliferation of mobile devices, growth in internet penetration, and public investments in digital infrastructure have enabled a gradual shift from paper-based systems to platform-based governance. Concurrently, global paradigms such as open government, digital inclusion, and citizen-centric innovation, captured in international indices like the UN E-Government Development Index and the World Bank’s GovTech Maturity Index, have influenced national aspirations and strategy formulation. However, these technological and global catalysts can only be transformative when embedded within a coherent legal and policy framework that ensures institutional legitimacy, citizen trust, and systemic accountability. In this regard, digital governance’s legal and policy foundations are critical for establishing enabling conditions for its practical and equitable implementation. As highlighted by Sachdeva (2002), the transition to digital modes of governance requires not only the removal of outdated regulatory provisions but also enacting new laws on digital authentication, electronic records, data protection, cybercrime, and privacy. Additionally, procedural simplification through single-window systems, interoperability standards, and e-payment protocols is essential to reduce administrative friction and promote

I. ROLE OF INTELLECTUAL PROPERTY

The international community has set itself the target of reducing the proportion of people below poverty line to half by 2015, along with associated specific targets for improving health and education and environmental sustainability. The Millennium Development Goals, adopted at various international fora, recognize the crucial importance of reducing poverty and hunger, improving health and education, and ensuring environmental sustainability. It is important to know whether and how intellectual property rights (IPRs) could play a role in helping the world meet these targets — in particular by reducing poverty, helping to combat diseases, enhancing access to education and contributing to sustainable development, protecting our cultural heritage, safeguarding the food security for the country. It is also necessary to deliberate whether and how they create obstacles to meeting those targets and, if so, how those obstacles can be removed.

There are strong views from both sides on the protection and enforcement of IPRs though there is no data to check these views objectively. Some argue strongly that IPRs are necessary to stimulate economic growth, which in turn, helps in poverty reduction. By stimulating invention and new technologies, IPRs help to increase agricultural or industrial production, promote domestic and foreign investment, facilitate technology transfer and improve the availability of medicines necessary to combat diseases. They are also of the view that there is no reason why a system that has worked for developed countries would not work for developing countries. Others argue equally vehemently the opposite. IPRs do little to stimulate invention in developing countries, because the necessary human and technical capacity may be absent there. In assessing these opposing arguments, it is important to remember the technological disparity between developed and developing countries as a group. What role the intellectual property can play to plug this gap is a serious subject for every developing nation? For this, it is also pertinent to know about the IPRs, the challenges they pose to the legal system in general and to the Indian legal system in particular, and their basic rationale to take a considered approach in their implementation.

General Introduction 
Growing populations and industrialisation around the world are driving up energy demand, which increases reliance on fossil fuels. The World Energy Forum projects that global stocks of fossil fuels like coal, natural gas, and oil will run out in less than ten years and decades [1]. Fossil fuels account for 88.1% of total energy consumption; they include coal (43%), oil and other liquids (23%), waste (6%), natural gas (6%), and biomass (24%). Hydroelectricity, and nuclear energy, on the other hand, share relatively small percentages of energy (1% and 2%, respectively) [2]. Petro-diesel, also known as petroleum diesel, is currently utilized as a fossil fuel and is created when crude oil is fractionally distilled at temperatures between 250°C and 350°C under atmospheric pressure. Once heated to a certain degree, the different types of diesel fuel are formed via the vaporization of hydrocarbon chains and the isolation and blending of constituents in a prescribed ratio. Typically, 25% of the petrodiesel’s composition consists of aromatic hydrocarbons and 75% of saturated hydrocarbons. The combustion of diesel fuel releases sulfur, nitrogen, and particulate matter into the environment, which are all present in significant concentrations in petro-diesel. Moreover, burning fossil fuels has resulted in several environmental problems, such as greenhouse gas emissions (GHG), which have a major impact on global warming, climate change, and a host of other chronic illnesses [3]. India is ranked as the fourth-biggest importer and user of petroleum products and crude oil. With demand for oil reaching about 4.1 million gallons per day in 2015, there is a growing disparity between India’s oil supplies and supply. The IEA analysis predicts that beyond 2050, there won’t be any oil reserves and that India’s oil consumption will increase by 6.0 million barrels per day to 9.8 mg/d in 2040 [4]. Two-thirds of the growth in oil demand and 16% of the increase in

There are different forms of intellectual property like Patents, Copyright, Trademarks, Industrial design, Plant Varieties etc. Various meeting and conventions were also convened for the protection in these intellectual properties at international level from time to time and to bring uniformity and coordination among member countries. These were reflected in different treaties, which are mentioned below. Among all these treaties/conventions the agreement on Trade related aspects of intellectual property rights (TRIPS), which runs under aegis of World Trade Organization is most influential, comprehensive and inclusive of all.

The rate of flow of water in open channel can be determined by multiplying the cross sectional area of the flow section at right angles to the direction of flow by the average velocity of water. In area-velocity method, the water can be measured at motion. The water is measured in motion by means of rate of flow or discharge and is expressed in litre per second (lps), litre per minute (lpm), cubic metre per second (m³/s), etc. Litre per second: A continuous flow amounting to 1 litre passing through a point each second. Cubic metre per second: A flow of water equivalent to a stream of 1 m long, 1 m wide and 1 m deep flowing at a velocity of 1 metre per second. Construction of Parshall flume

Parshall flume is a water measuring device that can be used to measure water flowing in an open channel and intended primarily for use in irrigation. The flume consists of a converging inlet section, a throat section with straight parallel sides, and a diverging outlet section (Fig.61.1). The floor of the converging section is level with walls which converge in the direction of flow, towards the throat. The throat section constitutes the middle portion of the Parshall flume. The floor of the throat section is dips downward in the direction of flow, but the walls are parallel. The throat width specifies the dimensions of the parshall flume. The diverging outlet section of the flume has a floor which rises in the direction of flow. The walls become further separated in the direction of flow (diverge).The parshall flume can be constructed by G.I. sheet, aluminum sheet, M.S. sheet, brick masonry, reinforced concrete or timber. Flumes made of G.I. or aluminum sheets are easily portable. Brick masonry and concrete flumes are permanently constructed in the channels. Stilling wells should be constructed at the side to take measurements.

An orifice is an opening in a bulk head with closed perimeter usually circular or rectangular cross-section through which water flows. For measurement of water, orifices are fabricated by making an accurate cut of proper size and shape in a mild steel sheet, aluminum plate etc. Proper machining is done to have a sharp edge through which water flows (Fig.60.1).

A weir is a notch or opening of some definite shape installed on a channel or a stream through which waterfalls (Fig.59.1). Materials like wood, concrete, mild steel, rigid PVC etc. can be used for construction of a weir. Mainly a cut on a sheet metal is used for fabrication of weirs, to be installed at various locations in a channel. Advantages of weirs are (i) capable of accurately measuring a wide range of flows (ii) easy to construct, portable and adjustable (iii) tends to provide more accurate discharge rating than flumes and orifices.

Theory

A venturimeter is a device used to measure the rate of flow of a fluid through a pipe and is often fixed permanently at different sections of the pipeline to know the discharge there. Venturimeter consists of three parts: (i) a short converging part (ii) a throat (iii) a diverging part (Fig.62.1). In the venturimeter, the fluid is accelerated through a converging cone of angle 15-20° and the pressure difference between the upstream side of the cone and the throat is measured, and provides the signal for the rate of flow. Due to the constriction there is an increase in the flow velocity and hence an increase in the kinetic energy. The fluid slows down in a cone with smaller angle (5-7°) where most of the kinetic energy is converted back to pressure energy. Because of the cone and the gradual reduction in the area there is no “vena contracta”. The flow area is at minimum at the throat.
